Terms of Service

1. Acceptance of Terms

By accessing or using GoFans, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the platform. These terms constitute a legally binding agreement between you and GoFans.

2. Safe Harbour Protection

GoFans claims Safe Harbour protection under Section 79 of the Information Technology Act, 2000. This protection is contingent upon our compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2026, as amended. By using GoFans, you acknowledge that the platform operates as an intermediary under Indian law.

3. Eligibility

GoFans is available to Indian residents aged 18 or older. Creators must provide valid identification and bank account details for verification and payment processing. By creating an account, you represent and warrant that you meet these eligibility requirements.

4. Account Registration

  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • One account per person; no duplicate accounts
  • We reserve the right to suspend or terminate accounts at our discretion
  • You consent to receiving mandatory quarterly advisories via email, push notification, or in-app pop-up as required by IT Rules 2026

5. Strictly Prohibited Content

Users are strictly prohibited from hosting, displaying, or uploading content that mirrors Rule 3(1)(b) of the IT Rules, 2026. The following content is prohibited:

  • Content that is obscene, pornographic, or pedophilic
  • Content invasive of another's bodily privacy, including deepfake nudity
  • Content deceptive or misleading about its origin (impersonation)
  • Content harmful to children (CSAM)
  • Content that violates Indian law, including IT Act Section 67 and IPC Section 292
  • Content that infringes on intellectual property rights
  • Content promoting violence, hate speech, or discrimination

Violation will result in immediate account termination and reporting to the appropriate authorities under the Bharatiya Nyaya Sanhita, 2023.

6. Synthetically Generated Information (SGI)

The IT Rules 2026 amendments bring deepfakes and AI-generated content under strict regulatory oversight. If you upload realistic AI content, you must declare it and comply with the following:

  • Creators are legally obligated to declare at the time of upload whether content is "Synthetically Generated Information" (SGI) — meaning it was created or modified by AI to appear real
  • Creators consent to the platform applying continuous, prominent on-screen labels (for video/images) or audio disclosures (for audio) identifying the content as synthetic
  • Creators consent to the platform embedding permanent, tamper-resistant metadata containing a unique identifier traceable to the platform's system
  • Creators agree not to attempt to strip or alter this metadata

7. Content Takedown Timelines

GoFans reserves the absolute right to remove or disable access to content without prior notice to comply with legal timelines under IT Rules 2026. By using the platform, you acknowledge and accept:

  • Content will be removed within 3 hours of a government or court order
  • Content will be removed within 2 hours for severe violations, including non-consensual intimate imagery, deepfake pornography, or impersonation

8. Content Moderation

All uploaded content is subject to AI and human moderation. GoFans reserves the right to remove any content that violates these terms without prior notice. Repeat violations will result in account termination. GoFans applies continuous, prominent on-screen labels to SGI content as required by law.

9. Mandatory Quarterly Advisories

By using the platform, you consent to receiving mandatory notifications at least once every three months (via email, push notification, or in-app pop-up). These advisories detail the platform's Terms of Service, the prohibition of unlawful SGI/deepfakes, and the legal and penal consequences of violating these rules. This requirement is mandated by IT Rules 2026.

10. Creator Earnings

  • Creators receive 85% of subscription revenue
  • Payouts are processed to Indian bank accounts via UPI, RuPay, or NEFT
  • Minimum payout threshold applies
  • TDS is deducted as per Indian tax regulations
  • GoFans is not responsible for bank processing delays

11. Fees and Payments

GoFans charges a platform fee of 15% on all creator earnings. No additional fees are charged to fans for browsing. GoFans supports UPI, RuPay cards, and domestic digital wallets for Indian users. Payment processing fees may apply as determined by payment providers.

12. Intellectual Property

Creators retain ownership of their content. By uploading content to GoFans, you grant us a non-exclusive license to display, distribute, and promote your content on the platform.

13. Prohibited Activities

  • Using the platform for illegal purposes
  • Circumventing content moderation systems
  • Creating multiple accounts to evade bans
  • Harassing, bullying, or threatening other users
  • Attempting to hack or disrupt platform operations
  • Scraping or collecting user data without consent
  • Stripping or altering SGI metadata

14. Data Retention and Evidence Preservation

Upon account deletion or the removal of content, GoFans is legally obligated to retain user registration data, upload logs, and relevant metadata for a minimum of 180 days for investigatory purposes as required by IT Rules 2026.

Creators acknowledge that the platform is required by law to disclose the identity of SGI violators to victims or their authorized representatives if a lawful process is initiated.

15. Grievance Redressal Mechanism

GoFans provides a dedicated Grievance Officer with contact details permanently displayed on the platform. The following timelines apply:

  • Grievances will be acknowledged within 24 hours
  • Grievances will be resolved within 7 days
  • Urgent content-related grievances will be resolved within 36 hours

16. Limitation of Liability

GoFans is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.

17. Termination

We may suspend or terminate your account at any time for violations of these terms. You may also delete your account at any time. Upon termination, your data will be handled as described in our Privacy Policy. User data will be retained for 180 days as required by law.

18. Governing Law

These terms are governed by the laws of India, including the Information Technology Act, 2000, IT Rules 2026, and the Bharatiya Nyaya Sanhita, 2023. Any disputes shall be subject to the exclusive jurisdiction of courts in India.

19. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.
